These terms and conditions apply between you, the User of this Website at www.countessantonia.org (including any sub-domains, unless expressly excluded by their own terms and conditions), and Countess Antonia, the owner and operator of this Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by Countess Antonia and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to Countess Antonia and accessing the Website in connection with the provision of such services.

You must be at least 18 years of age to use this Website. By using the Website and agreeing to these terms and conditions, you represent and warrant that you are at least 18 years of age and you have sufficient legal capacity to enter into this agreement or, if you lack such capacity, for instance, if you are under 18 years of age but are at least 13 years old (a "minor"), that you have obtained parental or guardian consent to do so.

Intellectual property and acceptable use

1. All Content included on the Website, unless uploaded by Users, is the property of Countess Antonia, our affiliates or other relevant third parties. Nothing on this Website shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any coat of arms, personal cypher, monogram, trademark, logo or service mark displayed on the Website without the owner's prior written permission.

8. You may cancel your registration at any time by informing us in writing to the address at the end of these terms and conditions. If you do so, you must immediately stop using the Website. Cancellation or suspension of your registration does not affect any statutory rights.

Password and security

9. When you register on this Website, you will be asked to create a password, which you should keep confidential and not disclose or share with anyone.

10. If we have reason to believe that there is or is likely to be any misuse of the Website or breach of security, we may require you to change your password or suspend your account.

Payment

11. The fee for a consultation will vary depending on the duration of the session you request and reserve with Countess Antonia or the product/service ordered and will be shown on the Website and when ordering.

12. In order to pay for the consultation or product/service, you will need to provide payment card details. You must have appropriate authority to use the payment card which you use for payment.

13. If you reserve a consultation or purchase a product/service, you will need to provide payment card details at the time of reservation or purchase. Your card will be charged at the time of reservation or purchase, following which you will receive your payment receipt or invoice sent via email for the charges you have incurred.

14. You agree and hereby authorise Countess Antonia to charge your debit or credit card with any charges for the consultation or product/service that you have reserved or purchased from Countess Antonia via the Website. Any failure of authorisation processes will result in the consultation or product/service not being provided and any consultation or product/service reserved or purchased will be cancelled.

15. Payment processing services are provided by Stripe. The details you provide via the Website or Countess Antonia are passed directly to Stripe and will be subject to its terms of use and privacy policy (https://stripe.com/gb/privacy). By inputting payment card details, you are consenting to use of the payment card details by Stripe for the purpose of paying for your reservation, purchase or order. If you have any questions relating to these services, please contact Stripe at privacy[at]stripe.com.

16. Countess Antonia and this Website does not store any of your payment card details on its systems.

Your rights to cancel

17. You may cancel an appointment for a consultation at any time up to 4 hours before the confirmed start time of your appointment without incurring any charges. If your appointment is within 4 hours, Countess Antonia may charge a cancellation fee of GBP £10 provided that you cancel at least 2 hours before your appointment. If you cancel within 2 hours you may at the discretion of Countess Antonia be charged the full consultation fee.

18. Once a consultation has started, you will be charged in full for the consultation.

19. For most physical products purchased online you have a legal right to change your mind and to receive a refund (Consumer Contracts Regulations 2013) up to 14 days (known as the 'cooling-off period') after the day you (or someone you nominate) receives the goods. Please see paragraph 20 for details on how to exercise this right.

a. If you cancel an order for a product item prior to notification being issued to you that the item has been dispatched or prior to your collection of the item, and you have paid for the item in full, Countess Antonia will reimburse to you all payments received from you in relation to the item, 14 days after the day on which Countess Antonia is informed about your decision to cancel the order.

b. If you cancel an order for a product item after notification has been issued to you that the item has been dispatched or after collection of the item by you, the item must be returned to, and received by, Countess Antonia, before any refund (excluding delivery or transport costs) will be paid.

c. The item must be returned in the condition you received it, which includes keeping where applicable any hygiene seals in place. You will lose your right to receive a refund if you unseal a product that needs to be sealed for health or hygiene reasons. Your entitlement to a refund may also be reduced in the event that non-faulty items being returned are damaged or used in any way. The amount by which your refund may be reduced will be dependent on the decrease in value of your use of the item. You should note that should your use mean that your item cannot be resold, this reduction may be 100%.

20. If you wish to cancel an order for a product item prior to receipt by you of notification that the item has been dispatched or prior to your collection of the item, or if you wish to cancel an order for a consultation, please email us at ca.support[at]countessantonia.org, and provide your name, address, phone number and details of the order you wish to cancel. You may use the cancellation form on your received payment receipt, but it is not obligatory.

a. If you wish to cancel an order for a product item after notification has been issued to you that the item has been dispatched or after collection of the item by you, please contact Countess Antonia at the address or contact information provided in the notification.

b. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

39. This Agreement shall be governed by and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.
